Terms of Service

By accessing or using the MeriTokens application, website (meritokens.com), or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including parents, guardians, and authorized users. Children under 13 may use the Service only under the supervision and consent of a parent or legal guardian.

MeriTokens provides a physical token and digital application system designed to help families manage children's screen time through a merit-based reward system. The Service includes: • The MeriTokens web application (play.meritokens.com) • The MeriTokens Android application • Physical NFC token hardware (where purchased) • The MeriTokens marketing website (meritokens.com) • Associated APIs and backend services

To use certain features of the Service, you must create an account. You agree to: • Provide accurate, complete, and current information • Maintain the security of your account credentials • Promptly update account information if it changes • Accept responsibility for all activities under your account • Notify us immediately of any unauthorized account access You must be at least 18 years of age to create an account. Accounts may not be transferred to another person without our prior written consent.

MeriTokens takes children's privacy seriously. We comply with the Children's Online Privacy Protection Act (COPPA). • Children under 13 may only use the Service with verifiable parental consent • We do not knowingly collect personal information from children under 13 without parental consent • Parents and guardians can review, delete, or refuse further collection of their child's information by contacting us at privacy@meritokens.com • Child profiles within the app contain only a name/nickname and usage statistics — no contact information or personal identifiers For our full children's privacy practices, see our Privacy Policy.

MeriTokens offers both free and paid subscription plans. Billing: Paid plans are billed monthly or annually as selected at signup. All prices are in USD unless otherwise stated. Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods. Free Trial: If a free trial is offered, your payment method will be charged at the end of the trial unless you cancel before the trial ends. Price Changes: We may change subscription prices with 30 days' notice. Continued use after the effective date constitutes acceptance of the new price. Hardware: Physical NFC token purchases are final. Defective hardware may be exchanged within 30 days of purchase.

You agree not to: • Use the Service for any unlawful purpose • Interfere with or disrupt the Service or servers • Attempt to gain unauthorized access to any part of the Service • Reverse engineer, decompile, or disassemble any part of the Service • Use the Service to harass, abuse, or harm any person • Upload or transmit malicious code • Use automated scripts or bots to access the Service • Resell or redistribute the Service without authorization • Circumvent any security or access control measures

All content on the Service, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of MeriTokens or its content suppliers and is protected by applicable intellectual property laws. The MeriTokens name, logo, and all related marks are trademarks of MeriTokens. You may not use these marks without prior written permission. You retain ownership of any content you submit to the Service. By submitting content, you grant MeriTokens a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MERITOKENS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERITOKENS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE. MeriTokens's total liability for any claims arising from use of the Service shall not exceed the amount you paid to MeriTokens in the 12 months preceding the claim.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at meritokens.com/privacy to understand our data practices.

MeriTokens reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. We may retain your information as required by law or for legitimate business purposes.

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of San Diego County, California.
